These terms are a binding agreement between you and Revival LLC d/b/a PopScript ("PopScript", "we", "us"), a Delaware limited liability company operating from Nevada, United States. They cover the PopScript iPhone app and popscript.app.

By downloading or using PopScript, you accept these terms. If you do not accept them, do not use the app.

1. Who can use PopScript

You must be at least 13 years old. If you are under 18, you may only use PopScript with the involvement of a parent or guardian who agrees to these terms. You must not be barred from using the service under the laws of your country, and you must comply with the App Store's own terms.

2. What PopScript does

PopScript transcribes talking-head videos and automatically removes filler words, silences and repetitions, so you can review and finish the edit by editing text. It can also add captions, resize, add text and overlays, and export your video.

Automatic editing is not perfect. It may cut a word you wanted, miss one you did not, or mis-transcribe speech. You are responsible for reviewing the result before publishing it. We give no guarantee about the accuracy of transcripts, the quality of any edit, or the results you get from posting a video.

3. Your account

You are responsible for your account and for what happens through it. Keep your sign-in details secure and tell us promptly at hello@popscript.app if you think someone else has access. You must give accurate information and keep it up to date.

4. Plans, trials and billing

  • Subscriptions are sold as in-app purchases through Apple. Apple takes the payment and holds your payment details. We never see your card.
  • Every plan starts with a free trial. The trial has a usage limit, described in the app.
  • Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and your Apple ID is charged the price shown at purchase.
  • Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours beforehand.
  • Prices may change. We will tell you before a change affects you, and changes never apply to a period you have already paid for.
  • Each plan includes a number of editing minutes. One editing minute is one minute of source video transcribed. If you use up your minutes, you can wait for the next period or upgrade.

Cancelling. Cancel anytime in iPhone Settings › [your name] › Subscriptions. Cancelling stops the next renewal; it does not refund the current period.

Refunds. Purchases are handled by Apple, so refunds are at Apple's discretion under its own policy. Request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.

5. Your content stays yours

You own your videos, audio, transcripts and exports. We claim no ownership.

You give us a limited licence to host, copy, transmit and process your content only so we can run the service for you: transcribing audio, producing your transcript and letting you edit and export. The licence lasts only as long as we need it to provide the service, ends when you delete the content or your account, and does not let us publish, sell or train models on your content.

You confirm that you have the rights to any content you put into PopScript, and that it does not infringe anyone's rights or break the law.

6. Acceptable use

Do not use PopScript to:

  • Break the law, or infringe copyright, trademark, privacy or publicity rights.
  • Process recordings of people who have not consented, where their consent is required.
  • Create content that is sexually exploitative of minors, or that harasses, defames or threatens anyone.
  • Impersonate someone, or create deceptive media intended to mislead.
  • Reverse engineer, decompile or attempt to extract our source code or models, except where the law says you may.
  • Resell, rent or share access to the service, use it to build a competing product, or scrape it automatically.
  • Interfere with the service, get around usage limits, or test its security without our written permission.

We can suspend or close accounts that break these rules.

7. Our intellectual property

PopScript, including the app, website, designs, text and logos, belongs to us and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store terms. You get no other rights.

8. Third-party services

PopScript relies on providers including Apple, Deepgram, Supabase and RevenueCat, and lets you share videos to platforms such as TikTok, Instagram and YouTube. Their terms and privacy policies govern what they do. We are not responsible for third-party services, and linking to them is not an endorsement.

9. Apple's role

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claim about the app, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you believe content processed through PopScript infringes your copyright, email hello@popscript.app with: your contact details, identification of the work, identification of the infringing material, a statement that you believe in good faith the use is unauthorised, a statement that your notice is accurate, and your signature. We may remove content and close repeat infringers' accounts.

11. Privacy

Our Privacy Policy explains what we collect and how we handle it. In short: your video is never uploaded, and the compressed audio we send for transcription is deleted afterwards.

12. Suspension and termination

You may stop using PopScript at any time and delete your account by emailing hello@popscript.app. We may suspend or end your access if you break these terms, if we must for legal reasons, or if we stop offering the service. If we stop offering the service entirely, we will give reasonable notice. Sections 5 through 20 survive termination.

13. Changes

We may change the app or these terms. If a change is significant we will notify you in the app or by email before it takes effect. Continuing to use PopScript after that means you accept the new terms.

14. Disclaimers

PopScript is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, error-free, or that transcripts and automatic edits will be accurate. You use PopScript at your own risk, and you are responsible for keeping your own copies of your footage.

15. Limitation of liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, lost footage, or business interruption, even if we were told such damages were possible.
  • Our total liability for any claim relating to PopScript is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$100.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law, such as for fraud, death or personal injury caused by negligence.

16. Disputes, arbitration and class action waiver

Please read this section carefully; it affects your legal rights.

First, contact us at hello@popscript.app. Most problems can be sorted informally, and both sides agree to try for 60 days before starting formal proceedings.

If that fails, you and we agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in English. Arbitration will take place in Nevada, or by video or telephone, or in your home county if you prefer.

Class action waiver. Disputes must be brought individually. Neither side may bring a class, collective or representative action, and the arbitrator may not consolidate claims.

Exceptions. Either side may bring a claim in small claims court, and either side may seek an injunction in court to protect intellectual property.

Opting out. You may reject this arbitration agreement within 30 days of first accepting these terms by emailing hello@popscript.app with your name and the words "arbitration opt-out". Opting out does not affect the rest of these terms.

17. Indemnity

You agree to indemnify and hold harmless PopScript, its officers, employees and contractors from claims, damages, losses and reasonable legal fees arising from your content, your use of the service, or your breach of these terms or of anyone's rights.

18. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Where a dispute is not subject to arbitration, it will be heard in the state or federal courts located in Nevada, and both sides consent to that jurisdiction. If you live outside the United States, you keep any rights your local consumer law gives you that cannot be waived by agreement.

19. Consumers in the EEA and UK

Nothing in these terms removes your statutory consumer rights, including the right to a remedy for a service that is not as described. You have a right to withdraw from a purchase within 14 days, although by starting a subscription and using the service you may ask us to begin immediately, which can end that right once the service has been fully supplied. Your local courts remain available to you.

20. General

If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not transfer these terms; we may transfer them to a successor in a merger or sale of the business. These terms and the Privacy Policy are the entire agreement between us about PopScript.
